REQUEST FOR PRE-QUALIFICATION To: Interested Utility Contractors Re: Huntsville Irrigation Company Canal Piping Projects Subject: Invitation to Submit Pre-qualification Proposal for Construction of the Huntsville Irrigation Canal Piping Project INVITATION TO SUBMIT : Huntsville Irrigation Company (Owner), a private non-profit irrigation company in Huntsville, Utah, invites interested contractors to submit prequalification proposals for construction of the Owner 's Huntsville Irrigation Canal Piping Project. Prequalification for this project is required by the Owner. Only prequalified contractors will be allowed to submit a bid. DESCRIPTION OF WORK : The Project will be bid in three phases. All of the phases will be for the installation of owner-furnished HDPE buried piping and appurtenances. The phases will be bid one phase at a time - one phase per year for the next three years. The first phase will also include the construction of a new pipe intake/overflow structure. The phases will range in size from approximately $700,000 up to approximately $ 1.8 million, which includes the cost of the piping materials. HDPE pipe sizes range from 32-inch diameter to 6-inch diameter. Service laterals will be 1-1/2-inch and 4-inch diameter. Other contractor items of work include, fittings, valves, air release valves, trench repair, State Highway crossings (including some small diameter boring), county road crossings, power line extensions, telemetry, screening, flow measuring, and all other incidental items associated with the complete Project. NOTICE OF BONDS TO BE ISSUED NOTICE IS HEREBY GIVEN pursuant to the provisions of the Utah Refunding Bond Act, Title 11, Chapter 27, Utah Code Annotated 1953, as amended (the "Act ") that on October 16, 2012, the City Council (the "Council ") of Ogden City, Utah (the "Issuer ") adopted a resolution (the "Resolution ") in which it authorized the issuance of the Issuer 's Storm Drain Revenue Refunding Bonds, Series 2012 (the "Bonds "), in the aggregate principal amount of not to exceed Two Million Two Hundred Thousand Dollars ($2,200,000), to bear interest at a rate of not to exceed 3.50% per annum, to mature in not more than twelve (12) years from their date or dates, and to be sold at a price not less than ninety-eight percent (98%) of the total principal amount thereof, plus accrued interest to the date of delivery. The Bonds are to be issued for the purpose of (i) refunding all or a portion of certain of the Issuer 's outstanding storm drain revenue bonds and (ii) paying issuance expenses to be incurred in connection with the issuance and sale of the Bonds. The Series 2012 Bonds are special limited obligations of the Issuer payable from the net revenues of the Issuer 's storm drainage system. Notice is hereby given to the public and residents of Moroni City that the Moroni City Council will consider appointing an individual to fill the unexpired term of office held by council member Tracy Braithwaite. The term of the person appointed shall serve until the next municipal election.
Any individual interested in submitting his/her name for consideration must meet the following qualifications: (1) be a United States citizen; (2) be a registered voter of Moroni City; (3) be a resident of Moroni or a resident of a recently annexed area for 12 consecutive months preceding the date of appointment; and (4) all other requirements set forth in Section 20A-9-203, UCA.

The taxable property in the Annexed Area, if annexed to the District, will become subject to the District 's then currently authorized uniform tax levy for District services and for payment of the District 's outstanding indebtedness. All interested parties may appear before the Council at the above time and place and be heard either in support of or in opposition to the proposed annexation of the Annexed Area to the District. In order to protest against the proposed annexation of the Annexed Area to the District, each protest must be filed in writing with the City Recorder of Clearfield City in accordance with Section 17D-1-206 of the Utah Code and must explain the reason(s) for the protest. All protests must be filed no later than fifteen (15) days after the Public Hearing to be held on November 13, 2012. At the Public Hearing, the Council will give full consideration to all protests which shall have been filed and will hear and consider all interested persons desiring to be heard. After the conclusion of the Public Hearing and after the time for filing any protests, the Council shall adopt a Resolution either ordering the annexation of the Annexed Area to the District or determining that such annexation should be abandoned. If within 15 days after the hearing adequate protests have not been filed with the City Recorder as required by law, the Council may adopt a Resolution annexing the Annexed Area into the District. Section 17D 1 212 of the Utah Code Annotated 1953, as amended, provides that a person may file an action in district court challenging the annexation if (a) the person filed a written protest under Section 17D-1-206; (b) the person is a registered voter within the District; (c) alleges that the actions or procedures violated the law or is an owner of property in the Annexed Area and alleges that such property will not be benefitted by a service that the District provides. Any person who fails to protest in writing at or prior to the above stated time and place or who fails to file an action in district court within thirty (30) days in accordance with Section 17D-1-212 is estopped from later protesting a finding by the Council that the Annexed Area will be benefitted and shall be deemed to have consented to the annexation of such land to the District.
