NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Box Elder County Courthouse, 43 North Main, Brigham City, Utah, on March 20, 2012, at 12:15 p.m. of said day, for the purpose of foreclosing a trust deed originally executed on December 11, 2003 by Dennis M. Jeppesen and Sharr Jeppesen, as trustors, in favor of Bank One, NA, covering the following real property purported to be located in Box Elder County at 238 West 700 North, Brigham City, UT 84302 (the undersigned disclaims liability for any error in the address), and more particularly described as: Beginning at a point located West 712.8 feet from the Southeast corner of Block 65, Plat C, Brigham City Survey, thence West 132 feet, North 118 feet to South line of CHERRYWOOD ESTATES PLAT III, East 132 feet, South 118 feet to beginning. Less beginning at a point 844.8 feet West of the Southeast corner of Block 65, Plat C, Brigham City Survey, running thence East 12 feet; thence North 118 feet to South line of CHERRYWOOD ESTATES PLAT 3, thence West 12 feet; thence South 118 feet to the point of beginning. Together with all existing or subsequently erected or affixed buildings, improvements and fixtures; all easements, rights of way, and appurtenances; all water, water rights and ditch rights (including stock in utilities with ditch or irrigation rights); and all other rights, royalties, and profits relating to the real property, including without limitation all minerals, oil, gas, geothermal and similar matters. Parcel No.: 03-082-0026 The current beneficiary of the trust deed is JPMorgan Chase Bank, National Association and the record owners of the property as of the recording of the notice of default are Dennis M. Jeppesen and Shar Jeppesen. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee 's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
