AMENDED NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Box Elder County Courthouse, 43 North Main, Brigham City, Utah, on March 26, 2013, at 12:15 p.m. of said day, for the purpose of foreclosing a trust deed originally executed on December 26, 2003 by Jonathan N. White and Gail E. White, as trustors, in favor of IndyMac Bank, F.S.B., covering the following real property purported to be located in Box Elder County at 3625 West 1000 North, Tremonton City, UT 84337 (the undersigned disclaims liability for any error in the address), and more particularly described as: A part of the Northeast quarter of Section 6, Township 11 North, Range 3 West of the Salt Lake Base and Meridian. Beginning at a point 33.00 feet West of the Section line and on the South right-of-way line of 1000 North Street located South 00 ? 00 '17 " East along the East line of said Section 472.21 feet and South 78 ? 45 '12 " West 33.65 feet from the Northeast corner of said section and running thence South 00 ? 00 '17 " East 296.08 feet; thence South 78 ? 45 '12 " West 150.00 feet; thence North 00 ? 00 '17 " West 296.08 feet to said South right-of-way line of 1000 North Street; thence North 78 ? 45 '12 " East 150.00 feet along said South right-of-way to the point of beginning known as Lot 1, DESERT KNIGHT MINOR SUBDIVISION. The base of bearing is the East line of said Section 6, Township 11 North, Range 3 West, Salt Lake Base and Meridian as monumented by the Box Elder Surveyor assumed to bear North 00 ? 00 '17 " West. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 05-175-0022 The current beneficiary of the trust deed is OneWest Bank, FSB and the record owners of the property as of the recording of the notice of default are Jonathan N. White and Gail E. White, Trustees of the Family Trust dated the 16th day of January, 2001. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency.
