NOTICE OF TRUSTEE’S SALE

The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale, at the Sixth Judicial District Court of Utah at 50 South Main, #3, Manti, UT on December 27, 2012 at 1 p.m., of said day, for the purpose of foreclosing a trust deed originally executed by DAVID A. MURDOCK as trustor, in favor of KOMBI CAPITAL, LP, a Utah Limited Partnership, covering real property located at, Sanpete County Property, Fairview, Utah 84629 and more particularly described as:
Parcel #1:
Beginning at a point which is North 2046.00 feet along Section line and East 49.50 feet from the Southwest corner of Section 35, Township 13 South, Range 4 East, Salt Lake Base and Meridian; and running thence South 391.89 feet; thence East 208.71 feet, thence South 208.71 feet, thence East 181.98 feet; thence North 600.60 feet; thence West 390.69 feet to the point of beginning. 
Parcel #2:
Beginning 31 chains North .75 of a chain East and 9.1 chains South of the Southwest corner of Section 35, Township 13 South, Range 4 East, Salt Lake Base and Meridian; thence running East 208.71 feet; thence North 208.71 feet; thence West 208.71 feet; then South 208.71 feet to the point of beginning.
ALSO, LESS AND EXCEPTING THEREFROM that portion that lies within the State Highway.
The current beneficiary of the trust deed is REO RECOVERY, LLC and the record owner of the property as of the recording of the notice of default is David A. Murdock. 
The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage.
Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier's check or bank official check payable to REO Recovery, LLC. The balance must be in the form of a wire transfer, bank or credit union cashier's check, bank official check or U.S. Postal money order payable to REO Recovery, LLC. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
