NOTICE OF TRUSTEE 'S SALE The following described real property will be sold at public auction to the highest bidder, purchase price payable in lawful money of the United States of America at the time of sale, at the east entrance of the Weber County Courthouse, a/k/a Second Judicial District, 2525 Grant Avenue, Ogden, Utah, on Monday, July 2, 2012, at the hour of 3:00 p.m. of that day for the purpose of foreclosing a deed of trust originally executed by Earl C. Johns, in favor of Washington Mutual Bank, a Washington corporation, covering real property located at approximately 3336 Adams Ave., Ogden, Weber County, Utah, and more particularly described as: PART OF LOTS 8, 9 AND 10, BLOCK 1, LAKE VIEW TERRACE ADDITION, OGDEN CITY, WEBER COUNTY, UTAH, AND PART OF THE VACATED ALLEY ADJOINING SAID LOTS ON THE EAST AND DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE EAST LINE OF ADAMS AVENUE 214.06 FEET SOUTH FROM THE SOUTH LINE OF 33RD STREET, AND RUNNING THENCE SOUTH ALONG THE EAST LINE OF ADAMS AVE, A DISTANCE OF 53 FEET, THENCE EAST PARALLEL TO 33RD STREET 154.46 FEET, THENCE NORTH PARALLEL TO ADAMS AVENUE 53 FEET, THENCE WEST PARALLEL TO 33RD STREET 154.46 FEET TO THE PLACE OF BEGINNING. 05-093-0005 The current beneficiary of the trust deed is Deutsche Bank National Trust Company as Trustee for WAMU Mortgage Pass-Through Certificate Series 2005-AR2, and the record owner of the property as of the recording of the notice of default is Rodney Cordell Johns, as personal Representative of the Estate of Earl Cordell Johns, Deceased. The trustee 's sale of the aforedescribed real property will be made without warranty as to title, possession, or encumbrances. Bidders must be prepared to tender $20,000.00 in certified funds at the sale and the balance of the purchase price in certified funds by 10:00 a.m. the following business day. The trustee reserves the right to void the effect of the trustee 's sale after the sale based upon information unknown to the trustee at the time of the sale, such as a bankruptcy filing, a loan reinstatement, or an agreement between the trustor and beneficiary to postpone or cancel the sale. If so voided, the only recourse of the highest bidder is to receive a full refund of the money paid to the trustee. THIS IS AN ATTEMPT TO COLLECT A DEBT.
