AMENDED NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Box Elder County Courthouse, 43 North Main, Brigham City, Utah, on May 1, 2012, at 12:15 p.m. of said day, for the purpose of foreclosing a trust deed originally executed on September 18, 2007 by Shane M. Phippen and Jennifer D. Phippen, as trustors, in favor of Wells Fargo Bank, N.A., covering the following real property purported to be located in Box Elder County at 85 West 100 South, Willard, UT 84340 (the undersigned disclaims liability for any error in the address), and more particularly described as: Parcel 1: Beginning at a point lying 128 feet West of the Northeast Corner of Lot 10, Block 15, Plat A, WILLARD TOWNSITE SURVEY, thence South 80 feet; thence East 50 feet; thence North 80 feet; thence West 50 feet to the point to the beginning. Parcel 2: Beginning at a point 78 feet West and 80 feet South of the Northeast Corner of Lot 10, Block 15, Plat "A " Willard Townsite Survey; running thence South 120 feet, more or less, to South line of Lot 9 said Block 15; and running thence West 64 feet; thence North 120 feet, more or less to North line of Grantor 's property; thence East 64 feet to the point of beginning. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel Nos.: 02-051-0161 & 02-051-0038 The current beneficiary of the trust deed is Wells Fargo Bank, N.A. and the record owners of the property as of the recording of the notice of default are Shane M. Phippen and Jennifer D. Phippen. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee 's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
