NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Farmington District Court, 800 West State Street, Farmington, UT, on April 3, 2012, at 9:30 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on September 2, 2003 by Robin Z. Moke, as trustor, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Fieldstone Mortgage Company, its successors and assigns, covering the following real property purported to be located in Davis County at 1064 North Nayon Drive #N, Layton, UT 84040 (the undersigned disclaims liability for any error in the address), and more particularly described as: All of Unit 14, Building "A ", AMENDED NAYON HEIGHTS CONDOMINIUM, a Utah Condominium Project, as the same is identified in the Record of Survey Map recorded in Davis County, Utah, Together with: (a) the undivided ownership interest in said Condominium Project 's Common Areas and Facilities which is appurtenant to said Unit, (the referenced Declaration of Condominium providing for periodic alteration both in the magnitude of said undivided ownership interest and in the composition of the Common Areas and Facilities to which said interest relates); (b) the exclusive right to use and enjoy each of the Limited Common Areas which is appurtenant to said Unit, and (c) the non-exclusive right to use and enjoy the Common Areas and Facilities included in said Condominium Project (as said Project may hereafter be expanded) in accordance with the aforesaid Declaration of Survey Map (as said Declaration and Map may hereafter be amended or supplemented) and the Utah Condominium Ownership Act. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 10-012-0014 The current beneficiary of the trust deed is First Western Federal Savings Bank and the record owner of the property as of the recording of the notice of default is Robin Z. Moke. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee 's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
