NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Weber County Courthouse, 2525 Grant Avenue, Ogden, UT, on April 3, 2012, at 10:30 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on December 8, 2004 by Earl C. Johns, as trustor, in favor of Washington Mutual Bank, covering the following real property purported to be located in Weber County at 936 2nd Street, Ogden, UT 84404 (the undersigned disclaims liability for any error in the address), and more particularly described as: Parcel 1: The East 53.5 feet of Lot 2, Block 2, CARR SUBDIVISION in Ogden City Utah. Parcel 1A: Together with a right of way for ingress and egress which is described as follows: Beginning at a point which is North 8909 '45 " West 31.4 feet from the Southeast corner of Lot 28, in South EL RANCHO No. 2, SUBDIVISION, and running thence South 8909 '45 " East 12 feet; thence North 050 '15 " East 112 feet; thence to the right along a 20 foot radius curve 31.42 feet; thence South 8909 '45 " East 28 feet to the West line of the above described property; thence North 050 '15 " East 18 feet to the Northwest corner of said above described property; thence North 8909 '45 " West 47.68 feet: thence South 625 ' East to a point which is North 050 '15 " East 145.5 feet and South 89 09 '45 " East 12.88 feet from the place of beginning; thence North 8909 '45 " West 12.88 feet; thence South 050 '15 " West 145.5 feet to the place of beginning. Parcel No.: 12-003-0010 The current beneficiary of the trust deed is JPMorgan Chase Bank, National Association, successor in interest from the FDIC as Receiver of Washington Mutual Bank and the record owner of the property as of the recording of the notice of default is Rodney Cordell Johns, as personal representative of the estate of Earl Cordell Johns, deceased. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale.
