SECOND AMENDED NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Weber County Courthouse, 2525 Grant Avenue, Ogden, UT, on March 20, 2012, at 10:30 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on January 20, 2006 by Terrance L. Payne, as trustor, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Aegis Wholesale Corporation, its successors and assigns, covering the following real property purported to be located in Weber County at 1441 Darling Street #14, Ogden, UT 84403 (the undersigned disclaims liability for any error in the address), and more particularly described as: Unit 1, contained within the MOUNT OGDEN PARK TOWNHOMES NO. 2, a Utah Condominium Project as the same is identified in the Record of Survey Map recorded in Weber County, (as said Record of Survey Map may have heretofore been amended or supplemented) and in the Declaration recorded in Weber County (as said Declaration may have heretofore been amended or supplemented). Together with the appurtenant undivided interest in said project 's common areas as established in said Declaration and allowing for periodic alteration both in the magnitude of said undivided interest and in the composition of the common areas and facilities to which said interest relates. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 14-122-0001 The current beneficiary of the trust deed is Deutsche Bank National Trust Company as Trustee and the record owner of the property as of the recording of the notice of default is Terrance L. Payne. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee 's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
