NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the main entrance of the Second Judicial District Court located at 2525 Grant Avenue, Ogden, UT 84401 on January 12, 2012 at 10:00 AM on said day for the purpose of foreclosing a Trust Deed originally executed on February 6, 2009, by Holli M Fraley, as trustor in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Assurity Financial Services, LLC covering the following real property purported to be located in Weber County at 5668 Aspen Court, Ogden, UT 84403 (the undersigned disclaims liability for any error in the address) and more particularly described as: SEE EXHIBIT A UNIT 20, IN BUILDING "E " AS SHOWN IN THE RECORD OF SURVEY MAP OF YORKSHIRE MEADOWS CONDOMINIUM, PHASE 1, A UTAH CONDOMINIUM PROJECT APPEARING IN THE RECORDS OF THE COUNTY RECORDER OF WEBER COUNTY, UTAH IN BOOK 22 OF PLATS, AT PAGE 52 AS ENTRY NUMBER 782742, AND AS DEFINED AND DESCRIBED IN THE DECLARATION OF CONDOMINIUM, APPEARING IN SUCH RECORDS IN BOOK 1312, PAGE 133, OF RECORDS, TOGETHER WITH AN UNDIVIDED 0.847 PERCENT OWNERSHIP INTEREST IN AND TO THE COMMON AREAS AND FACILITIES PRESENT AND FUTURE AND SUBJECT TO THE OWNERSHIP THEREIN OF UNIT OWNERS IN FUTURE PHASES, WHICH SAID UNDIVIDED INTEREST MAY BE ADJUSTED PERIODICALLY AS TO BOTH MAGNITUDE AND THE COMMON AREAS AND FACILITIES TO WHICH IT RELATES IN THE EVENT FUTURE PHASES ARE ADDED TO SAID PROJECT. SUBJECT TO ALL LIENS FOR CURRENT AND FUTURE TAXES, ASSESSMENTS, AND CHARGES IMPOSED OR LEVIED BY GOVERNMENTAL OR QUASI-GOVERNMENTAL AUTHORITIES; ALL PATENT RESERVATIONS AND EXCLUSIONS; ANY MINERAL RESERVATIONS OF RECORD AND RIGHTS INCIDENT THERETO; ALL INSTRUMENTS OF RECORD WHICH AFFECT THE ABOVE-DESCRIBED PROPERTY OR ANY PORTION THEREOF, INCLUDING, WITHOUT LIMITATION, ANY MORTGAGE OR DEED OF TRUST; ALL VISIBLE EASEMENTS AND RIGHTS-OF-WAY OF RECORD; ALL EASEMENTS, RIGHTS-OFWAY, ENCROACHMENTS, OR DISCREPANCIES SHOWN ON OR REVEALED BY THE MAP OF OTHERWISE EXISTING; ALL OF THE TERMS AND PROVISIONS OF THE DECLARATION (INCLUDING SUBSEQUENT AMENDMENTS THERETO) AND MAP (INCLUDING SUBSEQUENT AMENDMENTS THERETO) THE PROVISIONS OF THE UTAH CONDOMINIUM OWNERSHIP ACT; AND ALL RULES REGULATIONS, AND AGREEMENTS LAWFULLY MADE AND/OR ENTERED INTO PURSUANT TO THE PROVISIONS OF SAID ACT AND THE DECLARATION. THE BENEFITS AND OBLIGATIONS HEREUNDER SHALL UNDER TO THE BENEFIT OF AND BE BINGING UPON GRANTOR AND ITS SUCCESSORS AND ASSIGNS, AND SHALL INURE TO THE BENEFIT OF AND BE BINDING UPON GRANTEE AND HIS (AND/OR HER OR ITS, AS THE CASE MAY BE) HEIRS, EXECUTORS, ADMINISTRATORS, SUCCESSORS AND ASSIGNS. The current beneficiary of the Trust Deed is HSBC Bank USA, National Association, as Trustee for ACE Securities Corp. Home Equity Loan Trust, Series 2005-RM2 and the record owners of the property as of the recording of the Notice of Default is Holli M Fraley. The sale is subject to bankruptcy filing payoff reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists the sale shall be void the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $5,000.00 deposit at the sale and the balance of the purchase price by 12:00 Noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to Robert J. Hopp & Associates, LLC. The balance must be in the form of a wire transfer, bank or credit union cashier 's check bank official check or U.S. Postal money order payable to Robert J. Hopp & Associates, LLC.
