NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Weber County Courthouse, 2525 Grant Avenue, Ogden, UT, on February 28, 2012, at 10:30 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on July 29, 2009 by Blaine D. Furgeson and Carol Furgeson, as trustors, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Academy Mortgage Corporation, its successors and assigns, covering the following real property purported to be located in Weber County at 4054 South 895 East, Ogden, UT 84403 (the undersigned disclaims liability for any error in the address), and more particularly described as: Apartment Unit 98, in Building M, COUNTRY HILLS MANOR CONDOMINIUM PHASE NO. 4, a Condominium Project under the Condominium Ownership Act of the State of Utah, as established by the Declaration and the Record of Survey Map recorded in the office of the Weber County Recorder on August 10, 1971, said condominium project being situated upon the following described real property in Weber County, State of Utah as reserved in Declaration of Covenants, Conditions and Restrictions, recorded August 10, 1971, Book 973, Page 26, of official records. Together with an undivided interest in and to the common area, as the same is established and identified in the declaration and map referred to hereinabove: Together with and subject to easements through said unit, appurtenant to the common area, and all other units, for the support and repair of said unit, of the common area, and all other units. Subject to the provisions of the Utah Condominium Ownership Act, the aforesaid "Declaration ", the aforesaid "Survey Map ", and all rules, regulations and agreements lawfully made and/or entered into pursuant to the provisions of the aforesaid act and declaration, and all easements, conditions and restrictions of record. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 06-132-0013 The current beneficiary of the trust deed is JPMorgan Chase Bank, National Association, successor by merger to Chase Home Finance LLC and the record owners of the property as of the recording of the notice of default are Blaine D. Furgeson and Carol Furgeson. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee 's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
