NOTICE OF TRUSTEE 'S SALE The following described real property will be sold at public auction to the highest bidder, purchase price payable in lawful money of the United States of America at the time of sale, at the east entrance of the Weber County Courthouse, a/k/a Second Judicial District, 2525 Grant Avenue, Ogden, Utah, on Monday, August 26, 2013, at the hour of 3:00 p.m. of that day for the purpose of foreclosing a deed of trust originally executed by Evergreen Montessori Property, L.L.C., in favor of Mountain America Federal Credit Union, covering real property located at approximately 5875 South Adams Avenue Parkway #100, Washington Terrace, Weber County, Utah, and more particularly described as: UNIT NO. 1A, CONTAINED WITHIN THE GARDNER PROFESSIONAL BUILDING CONDOMINIUM PROJECT, A CONDOMINIUM PROJECT AS THE SAME IS IDENTIFIED IN THE RECORD OF SURVEY MAP RECORDED ON DECEMBER 21, 2001 IN WEBER COUNTY, AS ENTRY NO. 1816254, IN BOOK 55 OF PLATS, AT PAGES 6 THROUGH 11 (AS SAID RECORD OF SURVEY MAP MAY HAVE HERETOFORE BEEN AMENDED OR SUPPLEMENTED) AND IN THE DECLARATION RECORDED IN WEBER COUNTY, AS ENTRY NO. 1816255 IN BOOK 2196 AT PAGE 890 (AS SAID DECLARATION MAY HAVE HERETOFORE BEEN AMENDED OR SUPPLEMENTED.) TOGETHER WITH THE APPURTENANT UNDIVIDED INTEREST IN SAID PROJECT 'S COMMON AREAS AS ESTABLISHED IN SAID DECLARATION AND ALLOWING FOR PERIODIC ALTERATION BOTH IN THE MAGNITUDE OF SAID UNDIVIDED INTEREST AND IN THE COMPOSITION OF THE COMMON AREAS AND FACILITIES TO WHICH SAID INTEREST RELATES. 07-586-0001 The current beneficiary of the trust deed is Mountain America Federal Credit Union, and the record owner of the property as of the recording of the notice of default is Evergreen Montessori Property, L.L.C.. The trustee 's sale of the aforedescribed real property will be made without warranty as to title, possession, or encumbrances. Bidders must be prepared to tender a cashier 's check in the amount of $20,000.00 at the sale. The balance of the purchase price must be paid by cashier 's check or wire transfer received by 12:00 noon the following business day. The trustee reserves the right to void the effect of the trustee 's sale after the sale based upon information unknown to the trustee at the time of the sale, such as a bankruptcy filing, a loan reinstatement, or an agreement between the trustor and beneficiary to postpone or cancel the sale. If so voided, the only recourse of the highest bidder is to receive a full refund of the money paid to the trustee. THIS IS AN ATTEMPT TO COLLECT A DEBT.
