NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Weber County Courthouse, 2525 Grant Avenue, Ogden, UT, on July 23, 2013, at 10:30 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on April 25, 2008 by Gerald K. Buchanan, as trustor, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Academy Mortgage Corporation, its successors and assigns, covering the following real property purported to be located in Weber County at 1304 Millcreek Drive, #6, Ogden, UT 84404 (the undersigned disclaims liability for any error in the address), and more particularly described as: Unit No. 4, Building A, contained within the BRIARWOOD CONDOMINIUM PROJECT, a Condominium Project as the same is identified in the Record of Survey Map recorded on January 26, 1973, in Weber County, as Entry No. 586369, in Book 1015, at Page 150 (as said record of survey map may have heretofore been amended or supplemented) and in the Declaration recorded in Weber County (as said declaration may have heretofore been amended or supplemented.) Together with the appurtenant undivided interest in said project 's Common Areas as established in said Declaration and allowing for periodic alteration both in the magnitude of said undivided interest and in the composition of the common areas and facilities to which said interest relates. A part of the West half of Section 22, Township 6 North, Range 1 West, Salt Lake Base and Meridian U.S. Survey, beginning at a point which is East 982.45 feet and South 552.08 feet from the Northwest corner of the said Southwest quarter section, said point being in the Northwest corner of the intersection of Tyler Avenue and 15th Street; running thence three courses along the West line of Tyler Avenue as follows: South 4 ? 53 '49 " West 336.72 feet Southerly along the arc of 142.61 feet radius curve to the right, 99.82 feet (L.C. bears South 24 ? 56 '55 " West 97.79 feet), and South 45 ? 00 ' West 1.54 feet to the North line of 16th Street; thence Westerly along the arc of a 293.81 feet radius curve to the left 163.41 feet (L.C. bears North 66 ? 46 '05 " West 161.05 feet), to the East line of Harrison Blvd; thence four courses along said East line of Harrison Blvd., as follows; Northerly along the arc of 5789.58 feet radius curve to the left 444 feet (L.C. bears North 5 ? 56 '51 " East 443.89 feet), North 2 ? 38 ' East 106.73 feet, North 5 ? 33 '10 " East 286.34 feet and North 2 ? 33 ' East 45.00 feet to the South line of Canyon Road; thence three courses along said South line as follows: North 61 ? 54 ' East 165.50 feet, Easterly along arc of a 2944.79 feet radius curve to the left 541.48 feet (L.C. bears South 61 ? 23 '43 " East 540.72 feet) and South 69 ? 29 '50 " East 242.89 feet to the West line of Mountain Road; thence two courses along said West line as follows: South 17 ? 47 '58 " West 180.00 feet and Southerly along the arc of a 515.78 feet radius curve to the left 81.23 feet to the North line of 15th Street; thence West 636.08 feet along said North line to the point of beginning. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 13-142-0004 The current beneficiary of the trust deed is Wells Fargo Bank, N.A. and the record owner of the property as of the recording of the notice of default is Gerald K. Buchanan. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency.
