NOTICE OF TRUSTEE 'S SALE The following property will be sold at public auction to the highest bidder on Thursday, the 18th day of July, 2013 at 2:00 p.m. at the Main Entrance of the Weber County Courthouse, 2525 Grant Avenue, Ogden, Utah, County of Weber, by CACHE TITLE COMPANY as SUCCESSOR TRUSTEE, under a Deed of Trust made by PATRICK LUNDY AND JENNIFER M. BELCASTRO, AS JOINT TENANTS, TRUSTOR(S) and recorded on April 12, 2007, as Entry No. 2255832, in the office of the Recorder of Weber County, Utah, given to secure an indebtedness in favor of STILLWATER MORTGAGE, LLC, Lender, and MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. ( "MERS "), Beneficiary. Said Deed of Trust was assigned by MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. ( "MERS ") AS NOMINEE FOR STILLWATER MORTGAGE, LLC, ITS SUCCESSORS AND ASSIGNS, to A NON-MERS MORTGAGE COMPANY, WEST RADC VENTURE 2010-2, LLC, A DELAWARE LIMITED LIABILITY COMPANY, ITS SUCCESSORS AND ASSIGNS, by instrument recorded June 3, 2011, as Entry No. 2529532, records of Weber County, Utah, and by reason of breach of obligations secured thereby, a Notice of Default was recorded on February 25, 2013, as Entry No. 2622165, of said official records. Successor Trustee will sell at public auction to the highest bidder for cash, payable in lawful money of the United States of America at the time of sale, without warranty as to title, possession or encumbrances, the following described property in the County of WEBER, State of Utah for the purpose of foreclosing a Deed of Trust executed by PATRICK LUNDY AND JENNIFER M. BELCASTRO, TRUSTOR(S), in favor of WEST RADC VENTURE 2010-2, LLC, A DELAWARE LIMITED LIABILITY COMPANY, BENEFICIARY covering the following real property purported to be located in Weber County at Approximately 3731 North Elkridge Trail, Eden, Utah, 84310 (the undersigned disclaims liability for any error in the address) and more particularly described as follows: Lot 6, ELKHORN SUBDIVISION, PHASE 1, Weber County, Utah, as recorded in the Weber County, Utah Recorder 's Office. Tax Parcel No. 22-129-0005 For the purpose of paying obligations secured by said Deed of Trust including fees, charges and expenses of Trustee, advances if any, under the terms of said Deed of Trust, interest thereon and the unpaid principal of the note secured by said Deed of Trust, with interest thereon as in said Note and by law provided. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. The sale is subject to a bankruptcy filing, a payoff, a reinstatement or any other condition of which the trustee is not aware that would cause the cancellation of the sale. If any such condition exists, that sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the Trustee a $5,000.00 deposit in the form of a cashier 's check at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The balance must be in the form of a wire transfer, cashier 's check or certified funds payable to CACHE TITLE COMPANY, SUCCESSOR TRUSTEE. Cash payments are not accepted.
