NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder, without warranty as to title, possession or encumbrances, at the front door of the Weber County Courthouse, 2525 Grant Ave, Ogden, Utah, Weber County, Utah, on June 25, 2013 at 10:00 a.m. of said day, for the purpose of foreclosing a Trust Deed originally dated May 14, 2010 executed by HEATH MCMANIGAL, as Trustor, in favor of BYRON C. MORTENSEN and TERI MORTENSEN, husband and wife, as Beneficiary, and recorded May 18, 2010, as Filing No. 2473035, in the office of the Recorder of Weber County, Utah, and more particularly described as follows: All of Lot 1, TREASURE ACRES SUBDIVISION AMENDED, Weber County, Utah, according to the official plat thereof. Tax Roll No. 19-199-0001 Purportedly known as 4048 West 3600 North, North Ogden, Utah 84404 (the undersigned disclaims liability for any error in the address). TOGETHER with all the improvements now or hereafter erected on the property, and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water, water rights and water stock, and all fixtures now or hereafter attached to the property, all as further described in said Trust Deed, without warranty as to title. The current beneficiary of the Trust Deed is BYRON C. MORTENSEN and TERI MORTENSEN, husband and wife and the record owner(s) of the property as of the recording of the Notice of Default are HEATH MCMANIGAL. The purchase price is payable in lawful money of the United States of America. Bidders must be prepared to tender to the Trustee a $5,000.00 non-refundable deposit in cashier 's check or certified funds at the time of sale to secure bid, and the balance of the purchase price must be paid in full in the form of a wire transfer, cashier 's check or certified funds within 24 hours from the time of sale. The sale is subject to a bankruptcy filing, a payoff, a reinstatement or any other condition of which the trustee is not aware that would cause the cancellation of this sale. Further, if any of these conditions exist, the sale will be null and void, the successful bidder 's funds shall be returned and the Trustee and Beneficiary shall not be liable to the successful bidder for any damages.
