NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Box Elder County Courthouse, 43 North Main, Brigham City, Utah, on June 4, 2013, at 12:15 p.m. of said day, for the purpose of foreclosing a trust deed originally executed on September 24, 2010 by Arthur L. Carr and Jean M. Carr, as trustors, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Home Savings of America, its successors and assigns, covering the following real property purported to be located in Box Elder County at 126 West 700 South, Brigham City, UT 84302 (the undersigned disclaims liability for any error in the address), and more particularly described as: Beginning at a point 70 feet East of the Southwest corner of Lot 1, Block 17, Plat B, BRIGHAM CITY SURVEY, thence East 95 feet, thence North 132 feet, thence West 95 feet, thence South 132 feet to the point of beginning. The improvement thereon being known as 126 W 700 S, Brigham City, UT 84302. Being the same property which, by Deed dated January 1, 1994, and recorded in the Recorder of Deeds of the County of Box Elder, Utah, in Book 564, Page 591, was granted and conveyed by Deloris A. Hill unto Arthur L. Carr and Jean K. Carr. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 03-134-0042 The current beneficiary of the trust deed is Freedom Mortgage Corporation and the record owners of the property as of the recording of the notice of default are Arthur L. Carr and Jean M. Carr. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee 's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
