NOTICE OF TRUSTEE 'S SALE The property described below will be sold at public auction to the highest bidder payable in lawful money of the United States at the time of sale. The sale will be held at the main entrance of the First District Court-Box Elder County, located at 43 North Main, Brigham City, Utah 84302-0873 on Monday, April 19, 2013 at 4:00 p.m. The purpose of the sale is the foreclosure of that certain Deed of Trust, dated JANUARY 21, 2011 ( "Deed of Trust "), granted by ROCKCREEK LIVESTOCK, LLC, a Utah limited liability company as Trustor (referred to herein as "Trustor "), in favor of Cub River Holdings, LLC, and its successors and assigns (collectively referred to herein as the "Beneficiary "), with DOUGLAS J. SHUMWAY, ESQ., an active member of the Utah State Bar located in Salt Lake City, Utah, acting as trustee ( "Trustee "). The Deed of Trust was recorded on JANUARY 31, 2011, as Entry No. 299264, Book 1149, Page 653, in the Official Records of the Box Elder County Recorder, State of Utah. The property subject to the Deed of Trust is situated in Box Elder County, State of Utah, and is more particularly described on the attached Exhibit "A ", which is incorporated herein by this reference ( "Trust Property "). Parcel 1 (08-007-0022 and 08-007-0021 R/W: The South half of the South half of the South half of section 8, Township 14 North. Range 8 West, Salt Lake Base and Meridian. Together with a right of way 2 rods wide along the East side of the North half of the South half of the South half of said Section 8. Parcel 2 (08-025-0012): The North half of the North half of Section 33, Township 15 North, Range 8 West, Salt Lake Base and Meridian. Parcel 3 (08-025-0014): The North half of the North half of the South half of Section 33, Township 15 North Range 8 West, Salt Lake Base and Meridian. The Notice of Default and Election to Sell ( "Notice of Default ") associated with the Deed of Trust was recorded on November 14, 2012, as Entry No. 319342, Book 1193, Page 0382 in the Official Records of the County Recorder of Box Elder County, State of Utah. The current Beneficiary of the Deed of Trust is Cub River Holdings, LLC, as identified by the Deed of Trust, including its successors and assigns. The record owner of the Trust Property as of the recording of the Notice of Default was Trustor ROCKCREEK LIVESTOCK, LLC, a Utah limited liability company, whose mailing address is 2080 West 5900 North, Brigham City, Utah 84302. Bidders must tender to the Trustee, at the time of the sale, a $10,000.00 deposit in order to place a bid. The winning bidder must tender to the Trustee, at the address provided below, the remainder of the purchase price no later than 4:00 p.m. (MDT) on the next business day following the sale. The payment must be in the form of a cashier 's check and bank "Official Checks " are not acceptable. A Trustee 's Deed will be made available to the successful bidder within three (3) business days following receipt of the bid amount. The Trust Property is to be sold without any warranties whatsoever, including, but not limited to, any warranties of title, possession, or encumbrances.
