NOTICE OF TRUSTEE’S SALE


The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale, at the front steps of the Sixth Judicial District Court, Sanpete County, located at 160 North Main, Manti, Utah 84642, on Wednesday, March 20, 2013, at 2:00 p.m., for the purpose of foreclosing that certain Trust Deed with Assignment of Rents, dated December 22, 2011 (the “Trust Deed”) in favor of MERIDIAN TITLE COMPANY as original trustee (“Original Trustee”), and naming Paramount Investment Inc. as beneficiary, originally executed by Mountain Dominion Holdings, LLC, a Utah limited liability company, as Trustor, and recorded on December 22, 2011, as Entry No. 180989, in Book 625, at Page 173, of the official records of Sanpete County, Utah, covering real property in Sanpete County, Utah bearing Parcel Numbers 22483, 22483X14, and 22483X15, and more particularly described as follows (the “Property”):
Parcel No. 22483: The West half of the Northwest quarter of the Northeast quarter of the Northeast quarter and the East half of the Northeast quarter of the Northeast quarter of the Northeast quarter of Section 20, Township 14 South, Range 5 East, Salt Lake Meridian.
Parcel No. 22483X14: The West half of the Northeast quarter of the Northeast quarter of the Northeast quarter of Section 20, Township 14 South, Range 5 East, Salt Lake Meridian.
Parcel No. 22483X15: The East half of the Northwest quarter of the Northeast quarter f the Northeast quarter of Section 20, Township 14 South, Range 5 East, Salt Lake Meridian.
The current beneficiary of the Trust Deed is Paramount Investment Inc., and the record owner of the Property as of the recording of the Notice of Default is Mountain Dominion Holdings, LLC. The trustee’s sale will be made without warranty as to title, possession, quiet enjoyment, encumbrances, condition of the Property or any other matter.
The trustee’s sale shall also include, pursuant to Utah Code Ann. § 70A-9a-613, the personal property items located on or used in connection with the Property, including without limitation all appliances, equipment, machinery and other articles, as described in the Trust Deed. The debtor is entitled to an accounting of the unpaid indebtedness in this matter, and may request such an accounting by calling the undersigned Successor Trustee at the telephone number provided below.
Bidders at the trustee’s sale must be prepared to tender a $5,000.00 non-refundable deposit to the trustee and the balance of the purchase price within 24 hours of the sale. Both the deposit and the balance must be in certified funds, payable to Paramount Investment Inc.
Notice to Tenant
As stated in the accompanying Notice of Trustee's Sale, this property is scheduled to be sold at public auction to the highest bidder unless the default in the obligation secured by this property is cured. If the property is sold, you may be allowed under federal law to continue to occupy your rental unit until your rental agreement expires, or until 90 days after the date you are served with a notice to vacate, whichever is later. If your rental or lease agreement expires after the 90-day period, you may need to provide a copy of your rental or lease agreement to the new owner to prove your right to remain on the property longer than 90 days after the sale of the property.
You must continue to pay your rent and comply with other requirements of your rental or lease agreement or you will be subject to eviction for violating your rental or lease agreement.
The new owner or the new owner's representative will probably contact you after the property is sold with directions about where to pay rent.
The new owner of the property may or may not want to offer to enter into a new rental or lease agreement with you at the expiration of the period described above.
