NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Weber County Courthouse, 2525 Grant Avenue, Ogden, UT, on March 7, 2013, at 10:30 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on September 28, 2004 by Walter Kevin Amidan, as trustor, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Bank of Utah, its successors and assigns, covering the following real property purported to be located in Weber County at 1960 West 250 North, Marriott-Slaterville, UT 84404 (the undersigned disclaims liability for any error in the address), and more particularly described as: A part of the Southeast Quarter of Section 11, Township 6 North, Range 2 West, Salt Lake Base and Meridian, U.S. Survey: Beginning at a point which is North 41 ? 24 ' West 287.40 feet, North 75 ? 34 ' West 242.12 feet and North 12 ? 54 ' West 33.80 feet from the Southeast Corner of said Southeast Quarter, running thence North 75 ? 34 ' West 150.00 feet along the North Line of 250 North Street; thence North 12 ? 54 ' West 300 feet, thence South 75 ? 34 ' East 150 feet to the West Line of the State Highway; thence South 12 ? 54 ' East 300.00 feet along said West Line to the point of beginning. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 15-030-0029 The current beneficiary of the trust deed is DLJ Mortgage Capital, Inc. and the record owner of the property as of the recording of the notice of default is Walter Kevin Amidan. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency.
