On December 27, 2012 at 11:00 a.m. of said day the following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States, at the West entrance of the Sanpete County Courthouse at 160 North Main, Manti, Utah, for the purpose of foreclosing a trust deed executed by MARK LOWER and SUSAN LOWER, husband and wife, as joint tenants as Trustors, in favor of First American Title Insurance Agency, Inc. as Trustee (Substitution of Trustee recorded August 3, 2012 as Entry No. 185040 in Book 633 at page 1333 appointing Central Utah Title as Trustee) for the benefit and security of GARY MCDOUGAL OF MCDOUGAL & SONS as Beneficiary dated June 17, 2002 and recorded June 19, 2002 as Entry No. 095780 in Book 468 at page 2058 of Official Records in the office of the Sanpete County Recorder, covering the following described real property located in the County of Sanpete, State of Utah, and more particularly described as follows:
Lot 26, BLACKHAWK MOUNTAIN ESTATES, Plat B, Phase I, A Summer Home Subdivision, according to the official plat thereof, filed in the office of the Sanpete County Recorder. (Parcel No. 50095)
The current beneficiary of the trust deed is JANEAN HEYWOOD (Assignment of Beneficial Interest recorded August 3, 2012 as Entry No. 185039 in Book 633 at page 1332) and the record owners of the property as of the recording of the notice of default are MARK LOWER and SUSAN LOWER, husband and wife, as joint tenants. Said sale will be made without covenant or warranty, expressed or implied, regarding title, possession, condition or encumbrances to satisfy the obligation secured by and pursuant to the power of sale conferred in said Trust Deed.
Bidders must tender to the trustee a $5,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. Both the deposit and the balance must be in the form of a wire transfer, cashiers check or certified funds payable to Central Utah Title. Cash payments are not accepted. A trustees deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
