NOTICE OF TRUSTEE 'S SALE APN: 09-044-0042 Trust No. 11-00355-8 Ref: James W. Griffith Jr. Loan No. XXX IMPORTANT NOTICE TO PROPERTY OWNER YOU ARE IN DEFAULT UNDER A DEED OF TRUST DATED January 11, 2002. UNLESS YOU TAKE ACTION TO PROTECT YOUR PROPERTY, IT MAY BE SOLD AT A PUBLIC SALE. IF YOU NEED AN EXPLANATION OF THIS PROCEEDING, YOU SHOULD CONTACT A LAWYER. On January 4, 2013, at 10:30 A.M. James H. Woodall, as duly appointed Trustee under a Deed of Trust recorded on January 27, 2002, as Entry No. 1721895, in book 2966, at page 1028, of the official records in the office at the County Recorder of Davis County, State of Utah executed by James W. Griffith Jr. and Lori Ann Griffith, husband and wife, will sell at public auction to highest bidder, payable in lawful money of the United States at the time of sale. Successful bidders must tender a deposit of $20,000 in certified funds to the Trustee at the time of sale, with the balance due by noon the following business day, at the office of the Trustee. At the main entrance of the Davis County District Court, Bountiful Department, 805 South Main Street, Bountiful, Utah, all right, title and interest conveyed to and now held by it under said Deed of Trust in the property situated in said County and State described as: All of Lot 42, Dawn Development, Plat B, Layton City, Davis County, Utah, according to the official plat thereof, on file and of record in the Davis County recorder 's office. The street address and other common designation, of the real property described above is purported to be: 2165 North 1050 West, Layton, Utah 84041. The undersigned Trustee disclaims any liability for any incorrectness of the street address and other common designation, if any, shown herein. Said sale will be made without covenant or warranty, express or implied, regarding title, possession, condition or encumbrances, including fees, charges and expenses of the Trustee and of the trusts created by said Deed of Trust, to pay the remaining principal sums of the note(s) secured by said Deed of Trust.
