AMENDED NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Weber County Courthouse, 2525 Grant Avenue, Ogden, UT, on January 8, 2013, at 10:30 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on December 15, 2008 by Curtiss L. Lund and Rose M. Lund, as trustors, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Direct Mortgage, Corp., its successors and assigns, covering the following real property purported to be located in Weber County at 325 Highland Drive, Riverdale, UT 84405 (the undersigned disclaims liability for any error in the address), and more particularly described as: All that certain parcel of land situated in the County of Weber, State of Utah being known and designated as part of Lot 16, HIGHLAND VIEW SUBDIVISION, Weber County, Utah; Beginning at the Northeast corner of said Lot 16; running thence South 61 ? 07 ' East 198.75 ft; thence South 75 ? 04 ' West 145.9 ft; thence South 62 ? 41 ' West 12.81 ft; thence North 47 ? 44 ' West 92.19 ft to street; thence Northeasterly along street to beginning, being more fully described in Deed Instrument No. 208755L. Dated 02/24/2005, Recorded 02/25/2005 in Weber County Records. Being the same parcel conveyed to Curtiss L. Lund and Rose M. Lund as joint tenants from Margaret S. Love and Fairen Love, Trustees of the Margaret S. Love Family Protection Trust, dated the 25th day of November, 2003, by virtue of a Deed dated 2/24/05, recorded 2/25/05, as Instrument No. 2087552 County of Weber, State of Utah. More Correctly Described As: Part of Lot 16, HIGHLAND VIEW SUBDIVISION, Weber County, Utah: Beginning at the Northeast corner of said Lot 16; Running thence 61 ? 07 ' East 198.75 feet; thence South 75 ? 04 ' West 145.9 feet; thence South 62 ? 41 ' West 12.81 feet; thence North 47 ? 44 ' West 92.19 feet to street; thence Northeasterly along street to beginning. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 06-026-0003 The current beneficiary of the trust deed is Wells Fargo Bank, N.A. and the record owners of the property as of the recording of the notice of default are Curtiss L. Lund and Rose M. Lund. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency.
