NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Weber County Courthouse, 2525 Grant Avenue, Ogden, UT, on January 3, 2013, at 10:30 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on June 19, 2007 by Richard Swanson and Sarah Swanson, as trustors, in favor of Citicorp Trust Bank, FSB, covering the following real property purported to be located in Weber County at 890 North 4400 West, Ogden, UT 84404 (the undersigned disclaims liability for any error in the address), and more particularly described as: Lot 1, ALLAN ROBINSON SUBDIVISION PHASE 2, Weber County, Utah, according to the official plat thereof, on file and of record in the office of the Weber County Recorder. Together with a 20-foot wide right-of-way, being 10 feet on each side of the following described centerline: Beginning at a point on the East line of 4400 West Street and South 00 ? 44 '23 " West 25.46 feet from the Northwest corner of the ALLAN ROBINSON SUBDIVISION, Weber County, Utah, and thence South 39 ? 05 '30 " East 41.18 feet; thence South 17 ? 55 '47 " East 54.28 feet; thence 81.76 feet along a curve to the left with a radius of 75.00 feet, included angle of 62 ? 27 '50 " and with a long chord that bears South 49 ? 09 '42 " East 77.78 feet; thence South 80 ? 23 '37 " East 105.68 feet; thence North 89 ? 17 '252 " East 32.85 feet; thence South 00 ? 44 '23 " West 125.94 feet to the North line of ALLAN ROBINSON SUBDIVISION PHASE 2 and the point of termination. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 15-027-0090 The current beneficiary of the trust deed is Bayview Loan Servicing, LLC, a Delaware Limited Liability Company and the record owners of the property as of the recording of the notice of default are Richard Swanson and Sarah Swanson. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee 's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
