NOTICE OF TRUSTEE 'S SALE The following described property will be sold at a public auction to the highest bidder at the Main Entrance, Ogden County Courthouse, 2525 Grant Avenue, Ogden, Utah 84401 on November 26, 2012, at 9:30 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on June 4th, 2007, and executed by Byron Krenek and Laze Daze Ranch, as Trustors, in favor of Gary James and Yuka Sasaki James, as Beneficiary, in which First American Title, was named as Trustee. The Trust Deed was recorded in Weber County, Utah, on June 5th, 2007, as Entry No. 2268784, of Official Records, all relating to and describing the real property situated in Weber County, Utah, particularly described as follows: Beginning at a point 2089.89 feet west and 54.00 feet north from the southeast corner of section 30, township 7 north, range 2 west, Salt Lake base and meridian; thence west 209.19 feet; thence north 29 ? 30 ' east 139.66 feet; thence north 12 ? 43 ' east 100.00 feet; thence north 3 ? 13 ' east 44.54 feet; thence east 122.36 feet; thence south 267.00 feet to the point of beginning. (proposed lot 1, Parkview subdivision phase 1). Parcel No.: 19-028-0044 The current beneficiaries of the trust deed are Gary James and Yuka Sasaki James and the record owner of the property as of the recording of the notice of default was Laze Daze Ranch & Byron Krenek. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $5,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the date following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to Arnold & Wadsworth. The Balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or a U.S. Postal money order payable to Arnold and Wadsworth. Cash payments are not accepted. A trustee 's deed will be delivered to the successful bidder within three business days after receipt of the amount bid. Notice to Tenant As stated in the accompanying Notice of Trustee 's Sale, this property is scheduled to be sold at a public auction to the highest bidder unless the default in the obligation secured by this property is cured. If the property is sold, you may be allowed under federal law to continue to occupy your rental unit until your rental agreement expired, or until 90 days after the date you are served with a notice to vacate, whichever is later. If your rental or lease agreement expires after the 90-day period, you may need to provide a copy of your rental or lease agreement to the new owner to prove your right to remain on the property longer than 90 days after the sale of the property. You must continue to pay your rent and comply with other requirements of your rental or lease agreement or you will be subject to eviction for violating your rental or lease agreement. The new owner or the new owner 's representative will probably contact you after the property is sold with directions about where to pay rent. The new owner of the property may or may not want to offer to enter into a new rental or lease agreement with you at the expiration of the period described above. " DATED: October 12, 2012.
