NOTICE OF TRUSTEE 'S SALE The following described real property will be sold at public auction to the highest bidder, purchase price payable in lawful money of the United States of America at the time of sale, at the east entrance of the Weber County Courthouse, a/k/a Second Judicial District, 2525 Grant Avenue, Ogden, Utah, on Monday, October 15, 2012, at the hour of 3:00 p.m. of that day for the purpose of foreclosing a deed of trust originally executed by Michael T. Pomeroy, in favor of Weber State Credit Union, covering real property located at approximately 2353 Harrison Blvd, Ogden, Weber County, Utah, and more particularly described as: PART OF LOT 1, BLOCK 35, PLAT C, OGDEN CITY SURVEY, WEBER COUNTY, UTAH: BEGINNING 41.25 FEET SOUTH FROM THE NORTHEAST CORNER OF SAID LOT 1; AND RUNNING THENCE SOUTH 41.25 FEET, THENCE WEST 132 FEET, THENCE NORTH 41.25 FEET, THENCE EAST 132 FEET TO THE PLACE OF BEGINNING. TOGETHER WITH A RIGHT-OF-WAY FOR ALL PURPOSES OF INGRESS AND EGRESS OVER THE FOLLOWING PART THEREOF: BEGINNING AT A POINT 35.25 FEET SOUTH OF THE NORTHEAST CORNER OF SAID LOT 1; AND RUNNING THENCE SOUTH 6 FEET, THENCE WEST 79.8 FEET, THENCE NORTH 6 FEET, THENCE EAST 79.8 FEET TO THE PLACE OF BEGINNING. SUBJECT TO A RIGHT-OF-WAY FOR ALL PURPOSES OF INGRESS AND EGRESS OVER THE FOLLOWING DESCRIBED TRACT OF LAND: PART OF LOT 1, BLOCK 35, PLAT C, OGDEN CITY SURVEY, WEBER COUNTY, UTAH: BEGINNING AT A POINT 41.25 FEET SOUTH OF THE NORTHEAST CORNER OF SAID LOT 1; AND RUNNING THENCE SOUTH 6 FEET, THENCE WEST 132 FEET, THENCE NORTH 6 FEET, THENCE EAST 132 FEET TO THE PLACE OF BEGINNING. 02-032-0008 The current beneficiary of the trust deed is JPMorgan Chase Bank, National Association, and the record owner of the property as of the recording of the notice of default is Michael T. Pomeroy. The trustee 's sale of the aforedescribed real property will be made without warranty as to title, possession, or encumbrances. Bidders must be prepared to tender $20,000.00 in certified funds at the sale and the balance of the purchase price in certified funds by 10:00 a.m. the following business day. The trustee reserves the right to void the effect of the trustee 's sale after the sale based upon information unknown to the trustee at the time of the sale, such as a bankruptcy filing, a loan reinstatement, or an agreement between the trustor and beneficiary to postpone or cancel the sale.
