NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Weber County Courthouse, 2525 Grant Avenue, Ogden, UT, on August 21, 2012, at 10:30 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on May 5, 2003 by Curtis T. Smith and Colette H. Smith, as trustors, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Washtenaw Mortgage Company, its successors and assigns, covering the following real property purported to be located in Weber County at 3225 North 1000 West, Ogden, UT 84414 (the undersigned disclaims liability for any error in the address), and more particularly described as: Part of the Northwest Quarter of Section 30, Township 7 North, Range 1 West, Salt Lake Base and Meridian. Beginning at a point on the West right-of-way line of 1000 West Street located South 00 ? 10 '01" West along the Section Line 1820.62 feet and South 90 ? 00 '00" East 765.64 feet from the Northwest Corner of said Northwest Quarter and running thence South 01 ? 00 '00" West along said right-of-way line 120.00 feet; thence North 89 ? 00 '00" West 508.68 feet to an existing fence line; thence North 18 ? 20 '28" East along said fence line 125.71 feet; thence South 89 ? 00 '00" East 471.21 feet to the point of beginning. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 17-062-0075 The current beneficiary of the trust deed is JPMorgan Chase Bank, National Association and the record owners of the property as of the recording of the notice of default are Curtis T. Smith and Colette H. Smith. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency.
