NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Box Elder County Courthouse, 43 North Main, Brigham City, Utah, on July 31, 2012, at 12:15 p.m. of said day, for the purpose of foreclosing a trust deed originally executed on April 4, 2008 by Ryan Frandsen, as trustor, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Premium Capital Funding, LLC D/B/A Topdot Mortgage, its successors and assigns, covering the following real property purported to be located in Box Elder County at 6895 North 3600 West, Honeyville, UT 84314 (the undersigned disclaims liability for any error in the address), and more particularly described as: A part of the Northeast quarter of Section 6, Township 10 North, Range 2 West of the Salt Lake Base and Meridian. Beginning at a point on the West right-of-way line of 3600 West Street located South 00 ? 15 '29 " East 2182.92 feet along the East line of said Section and North 89 ? 53 '20 " West 33.00 feet from the Northeast corner of said Northeast quarter; running thence North 87 ? 39 '54 " West 865.54 feet; thence North 00 ? 06 '40 " East 252.39 feet to the South right-of-way line of 6900 North street; thence South 87 ? 37 '24 " East 863.94 feet along said South right-of-way line to said West right-of-way line of 3600 West; thence South 00 ? 15 '29 " East 251.83 feet along said West right-of-way line to the point of beginning. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 04-023-0043 The current beneficiary of the trust deed is Wells Fargo Bank, N.A. and the record owner of the property as of the recording of the notice of default is Ryan Frandsen. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder 's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier 's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier 's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency.
