NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale, at the Second District Courthouse, 2525 Grant Avenue, Ogden, UT 84401, on July 31, 2012, at 12:00 noon of said day, for the purpose of foreclosing a trust deed dated October 25, 2007, and executed by MARLA J. JOHNSON, as Trustor, in favor of AMERICA FIRST FEDERAL CREDIT UNION as Beneficiary, which Trust Deed was recorded on October 30, 2007, as Entry No. 2301857, in the Official Records of Weber County, State of Utah covering real property purportedly located at 911 East 1015 South #43, Ogden, Utah 84404 in Weber County, Utah, and more particularly described as: LOT 43, CONTAINED WITHIN THE CANYON PARK SUBDIVISION, A PLANNED RESIDENTIAL UNIT DEVELOPMENT, AS THE SAME IS IDENTIFIED IN THE PLAT RECORDED IN BOOK 18 OF PLATS AT PAGE 82 AND IN "DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS OF CANYON PARK, INC. " RECORDED IN BOOK 1083, AT PAGE 663, AS SAID DECLARATION HAS HERETOFORE BEEN AMENDED. TOGETHER WITH (I) A RIGHT AND EASEMENT OF USE AND ENJOYMENT IN AND TO THE COMMON AREA DESCRIBED, AND AS PROVIDED FOR IN SAID DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS, AS AMENDED; AND (II) THE EXCLUSIVE USE OF THE CARPORT(S), OPEN PARKING SPACE(S) AND/OR DRIVEWAY AREA(S) WHICH ARE ASSIGNED TO SAID LOT, AS SHOWN ON THE REFERENCED PLAT AND/OR AS DESCRIBED AND PROVIDED FOR IN SAID DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS AS AMENDED. THE FEE TITLE TO ANY LOT DESCRIBED AS BOUND BY ANY STREET, LANE, WALKWAY, PARK PLAYGROUND, LAKE, POND, POOL, OR ANY OTHER COMMON PROPERTY WHICH HAS NOT BEEN DEDICATED TO OR ACCEPTED BY THE PUBLIC, AND THE FEE TITLE TO ANY LOT SHOWN ON THE REFERENCED PLAT AS ABUTTING UPON SUCH COMMON PROPERTY AND THE FEE TITLE TO SUCH COMMON PROPERTY IS RESERVED TO THE GRANTOR TO BE CONVEYED TO THE CANYON PARK, INC., HOMEOWNERS ASSOCIATION FOR THE COMMON ENJOYMENT OF ALL THE RESIDENTS IN THE CANYON PARK SUBDIVISION. Tax ID: 13-150-0018 The current Beneficiary of the trust deed is AMERICA FIRST FEDERAL CREDIT UNION, and the record owner of the property as of the recording of the Notice of Default is MARLA J. JOHNSON. Bidders must tender to the trustee a $5,000.00 deposit at the sale and the balance of the purchase price by 2:00 p.m. the day following the sale. Both the deposit and the balance must be paid to Lincoln Title Insurance Agency in the form of a wire transfer, cashier 's check or certified funds.
