DAVIS COUNTY ORDINANCE NO. 2-2012 AN ORDINANCE AMENDING SECTION 2.64.060 OF THE DAVIS COUNTY CODE RELATING TO THE TERM OF OFFICE OF THE COUNTY CONSTABLE The Board of County Commissioners of Davis County, Utah, in a regular meeting, lawful notice of which has been given, finds that: WHEREAS the Utah State Legislature during the 2012 General Legislative Session amended Section 17-25-5 and Section 17-25a-3 which limited any contract between the County and a Constable to a period of four years, with the ability to renew or extend for another four years; and WHEREAS this ordinance provides compliance with that change in the statutes, and WHEREAS it is in the best interest of the County that this ordinance be adopted. THEREFOR E, the County Legislative Body of Davis County ordains as follows: Section 1 . Section 2.64.060 of the Davis County code is amended to read: Section 2.64.060 - Term of Office. A. Except when appointed to fill a vacancy, each constable shall be appointed for a term of four (4) years. B. A person appointed as constable to fill a vacancy shall be appointed to complete the remaining term of office of the prior constable. C. The Board of County Commissioners may, at its complete discretion, re-appoint a constable to serve an additional term of four years. D. Constables shall serve until the completion of the term or removal from office in accordance with applicable state law and the provisions of this chapter. Section 2. Effective Date. This ordinance shall take effect 15 days after its passage. This ordinance was duly approved and adopted by the Board of County Commissioners of Davis County, Utah on the 17th day of April, 2012, with Commissioners, P. Bret Millburn, Louenda H.
