NOTICE OF TRUSTEE'S SALE
The following described property will be sold at public auction to the highest bidder at the Main Entrance, Second Judicial District Courthouse, 800 West State Street, Farmington, Utah, on May 16, 2017, at 9:30 am, for the purpose of foreclosing a deed of trust recorded November 9, 2007 and executed by Ricardo Cuevas and Sandra Z. Cuevas, as trustors, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for HomeAmerican Mortgage Corporation, its successors and assigns, covering the following real property purported to be located in Davis County at 968 Caprice Lane, Fruit Heights, UT 84037 (the undersigned disclaims liability for any error in the address), and more particularly described as:
Lot 1-R-CS, DEER FIELD AT HIDDEN SPRINGS SUBDIVISION, according to the official plat thereof on file and of record in the Weber County Recorder's office. Less and excepting therefrom the land conveyed to Utah Department of Transportation by Final Order of Condemnation recorded April 29, 2005 as Entry No. 2069859 in Book 3778 at Page 875 of official records.
More Correctly Described As:
Lot 1-R-CS, DEER FIELD AT HIDDEN SPRINGS SUBDIVISION, according to the official plat thereof on file and of record in the Davis County Recorder's office.
Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property.

The current beneficiary of the deed of trust is Federal National Mortgage Association ("Fannie Mae") and the record owners of the property as of the recording of the notice of default are Ricardo Cuevas and Sandra Z. Cuevas.
The sale is subject to bankruptcy filing, payoff, reinstatement or other circumstance that affects the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder's funds returned, and the trustee and current beneficiary shall not be liable to the successful bidder for any damage.
A $20,000.00 deposit in the form of a bank or credit union cashier's check or a bank official check, payable to eTitle Insurance Agency, is required to bid. A successful bidder who fails to tender the full purchase price will forfeit the entire deposit. The successful bidder must tender the deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The balance must be in the form of a wire transfer, bank or credit union cashier's check, or bank official check payable to eTitle Insurance Agency. A bank or credit union cashier's check must be pre-printed and clearly state that it is a cashier's check. A bank official check must be pre-printed and clearly state that it is an official check. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within five business days after receipt of the amount bid.
